Painted child porn is still pornography, Dutch Supreme Court rules
The Dutch Supreme Court on Tuesday ruled that paintings of children performing sexual acts should be classed as child pornography and that lower court judges were right to find two men guilty of selling child porn in 2013.
The court ruled that the child pornography definition, which states images should be ‘realistic and life-like’, is not confined to photography. The fact that the painting included absurd elements, such as wings sprouting from the child’s back, is irrelevant, the court said.
The two men had been trying to sell the paintings online. One had confessed earlier that he produced the works partly based on pornographic photos featuring children.
Both men had been sentenced to community service at the original trial.
